The following is the
transcribed will of Allen A and Francis Spangler, recorded in Clay County,
Texas. I received the transcript from Ms. Betty Guthrie. Ms. Guthrie sent me
a copy of her transcription 23 April 2001.
Joint Last Will and
Testament of
Allen A. and Francis Spangler,
Husband and Wife
No. 609
The State of Texas
County of Clay
We, Allen A. and Francis Spangler, husband
and wife, of Clay County, Texas, being of sound and disposing mind, memory
and understanding, in view of the uncertainty of life, and for the purpose of
making the best disposition of our affairs, do hereby publish and declare
this our last will and Testament, revoking all former wills, if any by us
heretofore made.
It is our wish and desire that the survivor
Allen A. or Francis Spangler, as the case may be, shall have all our estate
and property, of every description, real, personal and mixed, to be used,
occupied and enjoyed during the life of such survivor, he or she as the case
may be. After the death of survivor the estate shall be divided equally among
our children: Charles A. Francis. Maud. Bell, E. Katie and George E. each to
share and share alike.
We however especially request and provide
that our daughter Maud, shall not dispose of her portion of our estate, but
hold the same in trust, using and enjoying only the income thereof for her
personal benefit during her life time, after he death the same is to go
equally and exclusively to her two children Joe and Francis Burks, and in
case of prior death of either child, then exclusively to the surviving child.
We hereby nominate, constitute and appoint
the survivor Allen A. or Francis Spangler, Executrix or Executor of this our
last Will and Testament, without bond or surety of any kind, and desire that
no further action shall be had in any of the courts of the county, save and
except the fileing of an inventory of our estate and the probating of this
will.
Witness our hands this the Sixteenth day of
September, A.D. 1915.

The above and foregoing will was signed in our presence by Allen A. and
Francis Spangler, husband and wife, and at their request and in their
presence and in the presence of each other we have subscribed our names as
witnesses.
